Cancellation and Refund Terms

These Cancellation and Refund Terms (“Policy”) govern the legal procedures and principles for cancellation, withdrawal, return, and exchange transactions related to purchases made through the website www.drmomhand.com (“Site”) operated by Dr. MomHand Organic Cosmetics (“Company”, “we”), registered in the United Kingdom.

This Policy has been drafted in full compliance with the consumer protection laws of the United Kingdom, where our company's global legal headquarters are located; specifically the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

ARTICLE 1 – ORDER CANCELLATION

1.1 Cancellation Before Shipment

You can cancel your orders free of charge before they are shipped (while they are in the process). Simply send your cancellation request to uk@drmomhand.com along with your order number and full name. In case of cancellation of orders that have not yet been shipped, the full amount collected will be refunded to the original payment method you used within 14 (fourteen) days at the latest.

1.2 Cancellation After Delivery to Cargo

If you request a cancellation after your order has been handed over to the shipping company, the order cannot be stopped. In this case, you can either refuse delivery and return the package to the courier, or you can initiate the return procedure under the legal right of withdrawal specified in Article 2 after receiving the product.

ARTICLE 2 – LEGAL RIGHT OF WITHDRAWAL (COOLING-OFF PERIOD)

Important: In accordance with the UK Consumer Contracts Regulations 2013, you have the right to cancel your order (withdraw from the contract) within 14 (fourteen) days of the date the product is delivered to you (or a third party you designate) and without incurring any legal or criminal liability and without giving any reason.

2.1 Cancellation Notification Method

To exercise your right of withdrawal, you must send a clear return request (email) including your order number to uk@drmomhand.com before the 14-day legal period expires. You can also use the Contact Form on our website for this purpose.

2.2 Consequences of the Right of Withdrawal and Refunds

If you exercise your right of withdrawal, your order amount and any standard delivery charges will be refunded to your original payment method within a maximum of 14 (fourteen) days after the returned products reach our company (or you provide proof of return).

ARTICLE 3 – RETURN ACCEPTANCE CONDITIONS

For a product to be considered within the scope of the legal right of withdrawal, it must meet the following conditions:

Packaging Integrity	The product's box, packaging, protective tapes, seals, or labels must be completely intact and undamaged.
Complete Delivery	Any promotions, gifts, and accessories sent with the product must be returned in their entirety.

(Note: The consumer is responsible for any decrease in the value of the product due to its use beyond what would be considered in a normal store, in terms of its nature, features, and functionality. Our company reserves the right to deduct this decrease in value from the refund amount.)

ARTICLE 4 – SITUATIONS WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

(HEALTH AND HYGIENE EXCEPTION)

According to the UK Consumer Contracts Regulations (Section 28), the statutory right of withdrawal cannot be exercised and returns will not be accepted in the following cases:

Opened Cosmetic Products: Dr. MomHand products are high-purity organic cosmetics. For health and hygiene reasons, returns are legally not possible for products whose packaging, cap, protective seal, or security seal has been opened after delivery.

Opened Cosmetic Products	Products with opened packaging, lid, tape or seal cannot be returned due to health and hygiene reasons.
Personalized Products	Orders prepared specifically according to the customer's particular requests.
Perishable Products	Products that are likely to spoil quickly or that may expire.

ARTICLE 5 – RETURN PROCESS AND SHIPPING COSTS

5.2 Return Shipping Costs

ARTICLE 6 – DELIVERY OF DEFECTIVE OR INCORRECT PRODUCTS (RIGHT TO REJECT)

Under the UK Consumer Rights Act 2015, you have specific rights if the product you receive is faulty, not as described, or unfit for purpose.

First 30 Days (Full Refund Right): If you discover within 30 days of delivery that the product is defective or incorrectly shipped, even if the packaging has been opened, you have the right to return the product and receive a full refund or a replacement.

In such cases, please stop using the product and contact us immediately at uk@drmomhand.com with photos showing the defect. In this case, the shipping costs will be covered by our company.

ARTICLE 7 – DISPUTE RESOLUTION AND COMPETENT JURISDICTION

7.1 These Cancellation and Refund Terms and Conditions are governed entirely by the laws of the United Kingdom (England and Wales).

7.2 In the event of any legal disputes arising from return processes, the courts of England and Wales shall have exclusive jurisdiction.

7.3 Consumers in European Union (EU) member states also have the right to use the European Commission’s Online Dispute Resolution (ODR) platform.
