ARTICLE 2 – SUBJECT AND SCOPE OF THE AGREEMENT
The subject of this agreement is the sale and delivery of the product, the specifications and sales price of which are detailed below, ordered electronically by the BUYER from the SELLER's website www.drmomhand.com, and the determination of the rights and obligations of the parties in accordance with the provisions of the United Kingdom Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.
By accepting this agreement, the BUYER acknowledges that, upon confirming the order, they will be obligated to pay the price of the order, the stated shipping cost, and any customs/import taxes.
ARTICLE 3 – INFORMATION ABOUT THE PRODUCT SUBJECT TO THE AGREEMENT
The basic specifications of the product are available on the SELLER's website. The prices listed and advertised on the site are the selling prices. Prices include taxes (VAT) applicable under United Kingdom legislation.

ARTICLE 4 – GENERAL PROVISIONS AND DELIVERY
4.1. The BUYER acknowledges that they have read and are aware of the preliminary information regarding the product subject to this contract and that they have the legal capacity to enter into a binding contract.
4.2. Unless otherwise agreed and in the absence of unreasonable delays, ordered goods will be delivered within 30 (thirty) days at the latest from the date of order confirmation (Consumer Rights Act 2015, Article 28).
4.3. Ownership and the risk of damage (loss, injury, etc.) to the products are transferred to the BUYER at the moment the products come into the physical possession of the BUYER or a third party designated by the BUYER.
4.4. The SELLER is responsible for delivering the product as described, in satisfactory quality, and fit for purpose. In case of a defective product, the BUYER has the right to request a full refund within 30 days from the delivery date.
ARTICLE 5 – RIGHT OF WITHDRAWAL (COOLING-OFF PERIOD)
Important: Under the UK Consumer Contracts Regulations 2013, you have the right to withdraw from a contract within 14 days of delivery without giving any reason.
5.1. In accordance with the United Kingdom Consumer Contracts Regulations 2013; the BUYER has the right to cancel the order and withdraw from the contract without giving any reason within 14 (fourteen) days of the date of delivery of the product to himself or to a third party at the address indicated.
5.2. To exercise the right of withdrawal, a clear cancellation notice must be sent to the SELLER's email address uk@drmomhand.com within this 14-day period.
5.3. The BUYER is obliged to return the products to the SELLER within 14 (fourteen) days at the latest from the date of notification of the decision to withdraw from the contract. The SELLER will refund the product price and standard delivery fee to the BUYER within 14 (fourteen) days at the latest after receiving the returned products or after proof of return shipment is provided.
5.4. In the event of exercising the right of withdrawal, the return shipping costs of the product to the SELLER shall be borne by the BUYER.
ARTICLE 6 – SITUATIONS WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED (EXCEPTIONS)
The right of withdrawal cannot be exercised under the following circumstances, in accordance with the 2013 Consumer Contracts Regulation (Section 28):
6.1. Custom-made goods, produced specifically to meet the consumer's particular requests or apparent personal needs.
6.2. Perishable goods or goods whose expiration date may pass quickly.
6.3. HEALTH AND HYGIENE EXCEPTION (Cosmetic Products): Returns of goods whose packaging, seal, protective tape, or wrapping has been opened after delivery are not legally permitted for health and hygiene reasons. The legal right of withdrawal becomes invalid if Dr. MomHand cosmetic products have been opened, tried, or used.
ARTICLE 7 – CUSTOMS AND IMPORT DUTIES (INTERNATIONAL DELIVERIES)
For deliveries to countries outside the United Kingdom, import duties, VAT or customs charges may be levied by local customs authorities upon arrival in the destination country. Such additional customs charges are entirely the responsibility of the BUYER. The SELLER has no control over the customs policies of the destination country.
ARTICLE 8 – DISPUTE RESOLUTION AND COMPETENT JURISDICTION
8.1. This agreement shall be governed by and construed in accordance with the laws of the United Kingdom, specifically the laws of England and Wales.
8.2. The courts of England and Wales shall have exclusive jurisdiction over any legal disputes arising from this agreement or the sale of the product. However, if the BUYER resides in Scotland or Northern Ireland within the United Kingdom, they shall also have the right to bring a case in the relevant local courts.
ARTICLE 9 – PROTECTION OF PERSONAL DATA
9.1. The SELLER protects the BUYER's personal data with high security standards in accordance with the UK Data Protection Act 2018 and the UK General Data Protection Regulation (UK GDPR).
9.2. The BUYER's personal data will be processed lawfully only for the purposes of processing the order, receiving payment, making the delivery, and fulfilling legal/tax obligations.

ARTICLE 10 – PAYMENT AND DELIVERY INFORMATION
10.1. Payment will be collected through international secure payment providers offered on the SELLER's website.
10.2. In cases where the shipping package is visibly damaged, the BUYER must have the delivery person prepare a damage report and refuse to accept the package.
10.3. The SELLER cannot be held responsible for delivery delays caused by extraordinary events beyond the SELLER's control (Force Majeure).
ARTICLE 11 – ENTRY INTO FORCE (AGREEMENT TO TERMS)
This agreement is deemed accepted and enters into force electronically at the moment the BUYER confirms the order (completion of the payment process). The BUYER acknowledges that they have read all of these terms and conditions before placing the order and that they are binding under the laws of the United Kingdom.
