Terms and Conditions of Use

The following terms and conditions of use (“Terms”) govern the legal rules and regulations regarding the use of the website www.drmomhand.com (“Site”) operated by Dr. MomHand Organic Cosmetics (“Company”, “we”, “our”), registered in the United Kingdom.

By using, visiting or shopping from the Site, you represent that you have read, understood and agree that these Terms are legally binding under the laws of the United Kingdom.

ARTICLE 1 – DEFINITIONS

ARTICLE 3 – MEMBERSHIP AND ACCOUNT SECURITY

3.1. Membership registration may be required to make purchases through the site. It is the User's responsibility to ensure that the information provided during the registration process is accurate, up-to-date, and complete.

3.2. The user is solely responsible for the confidentiality and security of their account information (username and password). The user will be held liable for all consequences arising from sharing account information with third parties.

3.3. If any unauthorized use or security breach of the account is noticed, the User must immediately report the situation to uk@drmomhand.com.

3.4. The Company reserves the right to suspend, close, or refuse service to User accounts without giving any reason, or specifically in cases of breach of these Terms.

ARTICLE 4 – PRODUCT AND SERVICE INFORMATION

4.1. While the product information, descriptions, images, and prices on the website are kept as accurate and up-to-date as possible, the Company does not guarantee that this information is always complete and error-free.

4.2. Product prices are subject to change without prior notice. However, price changes will not affect orders that were confirmed prior to the change.

4.3. Product images are for illustrative purposes only, and due to the natural properties of the product, there may be differences in color, texture, or packaging between the actual product and the images.

4.4. The company reserves the right to remove any product from the catalog, suspend sales depending on stock availability, or change product specifications.

4.5. Medical Warning: All our products are manufactured in accordance with organic cosmetic standards. Our products are not medicines and are not intended to treat any medical condition. It is the user's responsibility to assess their own health condition and consult a specialist physician if necessary regarding allergic reactions to the natural ingredients in the products.

ARTICLE 5 – ORDER AND PAYMENT

5.1. Placing an order on the site means you accept these Terms and Conditions and the Distance Selling Agreement.

5.2. The company reserves the right to cancel an order in cases where it suspects fraud, there is insufficient stock, or there is a pricing error. In this case, the amount collected will be fully refunded to the User.

5.3. Payment methods consist of the methods specified on the Site, such as credit cards, debit cards, and international secure payment providers (PayPal, etc.). Credit card information is not stored by the Company and is processed through infrastructures compliant with international security standards (PCI-DSS).

ARTICLE 6 – DELIVERY CONDITIONS

6.1. Orders will be delivered within 30 (thirty) days, the maximum legal period, from the date of payment confirmation, unless there are exceptional circumstances.

6.2. In international deliveries, the Company is not responsible for any delays that may arise from the customs policies of the destination country and for any import duties, customs fees or VAT that may be incurred; these costs are entirely the responsibility of the User.

6.3. For products damaged during shipping, the User must have a "Damage Assessment Report" prepared in the presence of the delivery person at the time of delivery and immediately notify the Company of the situation.

ARTICLE 7 – RETURN AND EXCHANGE POLICY (COOLING-OFF PERIOD)

7.1. In accordance with the UK Consumer Contracts Regulations (Consumer Contracts Regulations 2013), the User may exercise their right of withdrawal without giving any reason within 14 (fourteen) days of the delivery date of the product.

7.2. HEALTH AND HYGIENE EXCEPTION: It is a legal requirement that the returned product be unused, with its lid/packaging unopened, its seal intact, and in its original condition. Returns of opened or tested cosmetic products are strictly prohibited due to hygiene and health protection laws.

7.3. To initiate the return process, a written notification must be sent to uk@drmomhand.com. Return shipping costs (except for company errors or defective products) are the responsibility of the User.

ARTICLE 8 – INTELLECTUAL PROPERTY RIGHTS

8.1. All content on the site, including text, images, logos, trademarks, designs, software, graphics, and all other materials, is the property of Dr. MomHand Organic Cosmetics and is protected by international copyright.

8.2. The site's content may not be copied, reproduced, distributed, published, or used for commercial purposes without the prior written permission of the Company.

8.3. “Dr. MomHand” and “PHYTO-RESONANCE™” are our registered trademarks; unauthorized use will result in legal action.

ARTICLE 9 – PROTECTION OF PERSONAL DATA

ARTICLE 10 – LIMITATIONS OF LIABILITY

10.1. The Company cannot guarantee that the Site will operate continuously, without errors, or completely free from cyberattacks. The Company cannot be held responsible for disruptions that may occur due to technical problems or maintenance work.

10.2. When using the products, the User is obliged to follow the instructions stated on the product labels and descriptions. The Company is not legally responsible for any consequences arising from use contrary to the instructions or from the User's existing allergic conditions.

ARTICLE 11 – PROHIBITED USES

11.1. Unlawful use of the Site; Accessing the Site for the purpose of delivering viruses, malware, or cyberattacks (DDoS, etc.) is strictly prohibited.

11.2. Accessing the site using automated tools, bots, spiders, or data mining software is prohibited.

11.3. In case of creating fraudulent orders, opening fake accounts, or making transactions with stolen payment methods, the User account will be closed and legal authorities will be contacted immediately.

ARTICLE 12 – FORCE MAJEURE

Natural disasters, war, riots, epidemics, strikes, government or customs decisions, cyberattacks, and infrastructure problems—extraordinary events beyond the Company's control—are considered force majeure. During a force majeure event, the Company's obligations are suspended, and the Company cannot be held responsible for any resulting delivery delays.

ARTICLE 13 – DISPUTE RESOLUTION AND COMPETENT JURISDICTION

13.1. The interpretation and application of these Terms and Conditions, and any legal disputes arising therefrom, shall be governed entirely by the laws of the United Kingdom (England and Wales).

13.2. The courts of England and Wales shall have exclusive jurisdiction over any and all disputes arising from these Terms of Use or the use of the Site.

ARTICLE 15 – FINAL PROVISIONS

15.1. If any provision of these Terms is found to be invalid or unenforceable by a court decision, this shall not affect the validity and enforceability of the other provisions.

15.2. The Company's failure or delay in exercising any of its rights under these Terms shall not constitute a waiver of such rights.
